What happened
Tenants applied for an order determining that the Landlords gave a notice of termination in bad faith. The Landlords served the Tenants with an N12 notice to terminate the tenancy for the purpose of personal use by the Landlord's sister. The Tenants vacated the rental unit, but the Landlord's sister did not occupy the unit within a reasonable time.
The ruling
The Tenants' application alleging bad faith termination of the tenancy is dismissed. The Landlords rebutted the presumption of bad faith by providing evidence that the rental unit was sold to pay outstanding debts of the former landlord.
