What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants failed to pay the arrears specified in the N4 notice and did not void the notice prior to the application. At the time of the hearing, the Tenants remained in possession and had made no further payments, resulting in substantial arrears.
The ruling
The tenancy is terminated effective June 28, 2025, unless the Tenants pay $8,236.00 to void the order. If the Tenants do not void the order, they must vacate by the termination date and pay the Landlord $4,800.41, which accounts for arrears to the hearing date and the filing fee, minus the rent deposit and interest. Daily compensation of $67.40 is required for each day the Tenants remain past June 10, 2025.
