What happened

The Landlord applied for an eviction order after the Tenant allegedly failed to meet a condition specified in a previous Board order dated April 4, 2025. An ex parte order was subsequently issued on May 5, 2025, terminating the tenancy. The Tenant requested a review of this order on May 12, 2025, claiming she was unable to participate. The LTB reviewed the request and determined that a review is not the correct procedural mechanism for an ex parte order.

The ruling

The Tenant's request to review the ex parte order dated May 5, 2025, is denied. The original order remains in effect. The Tenant was advised that to contest the evidence or seek relief from eviction, she must file a motion to set aside the order by May 15, 2025, which would trigger a stay of the order and a hearing.
