What happened
The Landlord applied to evict the Tenants for non-payment of rent. The Tenants contested the lawful rent amount, arguing that a rent increase from $1,000.00 to $1,500.00 via a new lease was illegal. The Tenants also attempted to raise maintenance issues under section 82, which were denied due to lack of prior disclosure.
The ruling
The tenancy is terminated effective January 15, 2026, unless the Tenants void the order by paying the arrears. The lawful rent was set back to $1,000.00 after the Board found the Landlord's $500.00 increase via a new lease was illegal. The Tenants must pay $4,050.38 to the Landlord to cover arrears up to the hearing date and the filing fee, or higher amounts specified in the schedules to continue the tenancy.
