What happened

The Landlord obtained an ex parte eviction order after the Tenants breached a previous LTB payment plan order from February 2025. The Tenants failed to pay a scheduled arrears payment of $368.10 by June 15, 2025. The Tenants filed a motion to set aside the eviction order, claiming they forgot to pay due to being busy and prioritizing other bills. The Landlord argued that the Tenants have a history of late and incomplete payments since the start of the tenancy and currently owe over $2,200.00.

The ruling

The Tenants' motion to set aside the eviction order is denied. The stay of the eviction order is lifted effective September 15, 2025, providing the Tenants roughly four weeks to vacate the unit. The original eviction and payment order remains unchanged because the Tenants failed to demonstrate a valid reason for breaching the previous mediated payment schedule.
