What happened

The Landlords applied for an ex parte order to terminate the tenancy after Tenants allegedly breached a conditional order from March 2025. An eviction order was issued without a hearing. The Tenants filed a motion to set aside that order, arguing that a shortfall in their payment was based on a good-faith interpretation of a separate order concerning water quality issues and authorized rent deductions.

The ruling

The LTB set aside the eviction order issued on June 11, 2025. The tenancy is allowed to continue provided the Tenants pay the outstanding arrears of $3,410.30 according to a specific schedule: $900.00 by August 13, 2025; $1,255.14 by August 23, 2025; and $1,255.16 by September 23, 2025. The Tenants are also permitted a final deduction for August 2025 rent if the Landlords have not yet fully paid amounts from a previous order.
