What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant had been in the unit for 11 years but had fallen significantly behind in rent payments since early 2025. During the hearing, the parties agreed on the total arrears owing. The Landlord argued that the tenancy was no longer viable because the Tenant's monthly income from Ontario Works was less than the monthly rent, causing the Landlord financial strain and stress regarding mortgage and utility obligations.
The ruling
The tenancy is terminated effective November 29, 2025. The Tenant is ordered to pay the Landlord $6,761.40 for rent arrears up to the hearing date and the filing fee. If the Tenant stays past the hearing date, they must pay daily compensation of $28.77. The Tenant can void the eviction by paying $7,936.00 by November 29, 2025, which includes all rent owing up to the end of November.
