What happened

The Landlords applied for an order to terminate the tenancy and evict the Tenants for personal use of the rental unit. Following a hearing where the Tenants were absent, an order was issued in favor of the Landlords. The Tenants requested a review of the order, claiming they were unable to attend the hearing due to medical reasons related to pregnancy and being postpartum. However, the Board found that the Tenant's contemporaneous email communication on the morning of the hearing contradicted their later claims made in the review request.

The ruling

The Tenant's request for a review of order LTB-L-078697-24 is denied. The Board found the Tenant's explanation for their absence from the original hearing was not credible due to conflicting evidence provided by the Tenant themselves. The original order terminating the tenancy remains confirmed and unchanged.
