What happened

The Tenant applied for an order claiming the Landlord altered the locking system without providing keys and substantially interfered with the Tenant's reasonable enjoyment. However, the parties had previously settled all matters with a significant payment to the Tenant. The Tenant sought to proceed with the application, alleging the Landlord negotiated the settlement in bad faith by failing to disclose an intention to sell the property. The Landlord argued there was no obligation to disclose a potential sale and that they had fulfilled all terms of the settlement.

The ruling

The Tenant's application is dismissed. The Board determined that the parties had already reached a full and final settlement, and the Tenant's claim that the Landlord acted in bad faith by not disclosing a property sale was not supported by evidence. The application was considered an abuse of process given the existing settlement.
