What happened

The Landlords applied for the termination of the tenancy and eviction of the Tenants due to significant rent arrears. The Tenants failed to pay rent for several years, resulting in arrears exceeding $57,000. Despite the Landlord and Tenant Board's typical monetary jurisdiction limit of $35,000, the adjudicator noted that the full amount must be paid if the Tenants wish to void the eviction order. The Tenants did not attend the hearing.

The ruling

The tenancy is terminated effective September 14, 2025. To void the eviction, the Tenants must pay $58,686.00 by September 14, 2025 (which includes rent up to the end of September). If they do not void the order, they are ordered to pay the Landlords $57,154.50 plus daily compensation of $42.74 from August 26, 2025, until they vacate. The Landlords may file with the Sheriff for eviction starting September 15, 2025.
