What happened

The landlord applied for an order to terminate the tenancy and evict the tenants due to substantial interference with the reasonable enjoyment or lawful right, privilege or interest of the landlord or another tenant. The landlord alleged that the tenants or an occupant of the rental unit has substantially interfered with the landlord's reasonable enjoyment and lawful interest in the property by not maintaining the yard and common areas.

The ruling

The tenancy is terminated, and the tenants must move out by May 31, 2023. If the unit is not vacated by that date, the landlord may file the order with the Court Enforcement Office for enforcement. The tenants shall pay the landlord $186 for the application filing fee. The landlord owes the tenants $959.37 for the rent deposit and interest, which will be reduced by $46.03 per day for compensation if the unit is not vacated by May 31, 2023.
