What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's conduct of leaving an unacceptable amount of garbage outside the rental unit, which substantially interfered with the Landlord's reasonable enjoyment of the property. The Landlord also sought compensation for the Tenant's failure to pay utility costs and for the Landlord's reasonable out-of-pocket expenses related to the substantial interference.

The ruling

The tenancy is terminated effective June 11, 2023. The Tenant must vacate the rental unit by that date. If the Tenant does not vacate by June 11, 2023, the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenant is ordered to pay the Landlord $17,995.17, which includes compensation for use of the unit, unpaid utility costs, and the Landlord's out-of-pocket expenses. If the Tenant does not pay the full amount by June 30, 2023, the Tenant will owe interest at 6% annually on the outstanding balance.
