What happened

Tenants applied for an order determining that the Landlord gave a notice of termination in bad faith. The Tenants vacated the rental unit on September 30, 2023 after the Landlord told them she needed to sell the unit. The unit was subsequently listed for rent in November 2023.

The Tenants proved the Landlord acted in bad faith by terminating the tenancy under the pretense of selling the unit, when the unit was subsequently listed for rent. The Landlord must pay the Tenants $9,119.84, which includes a rent abatement and compensation for the increased rent the Tenants incurred.
