What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant failed to attend the hearing despite being properly served. Evidence showed that while the Tenant made some payments after the application was filed, significant arrears remained, and the Tenant did not respond to the Landlord's attempts to establish a repayment plan.

The ruling

The tenancy is terminated unless the Tenant pays $3,814.00 by August 31, 2025, or $4,619.00 by September 5, 2025, to void the order. If the order is not voided, the Tenant must vacate by September 5, 2025, and pay the Landlord $2,532.67 plus daily compensation of $26.47 until they move out.
