What happened
The landlord applied for an order to terminate the tenancy and evict the tenants due to their failure to meet a condition specified in a previous LTB order. The tenants failed to pay the lawful monthly rent on or before March 1, 2023 and failed to pay $638.29 towards the arrears by February 15, 2023 as required by the previous order.
The ruling
The tenancy is terminated effective May 9, 2023. The tenants must pay the landlord $9,758.85 (less any payments made after March 15, 2023) for rent arrears and the cost of the previous application, plus $53.57 per day in compensation for use of the unit starting April 29, 2023 until they move out. If the full amount is not paid by May 9, 2023, the tenants will owe interest at 6% annually on the outstanding balance.
