Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant's failure to meet a condition specified in the mediated settlement signed by the parties on January 25, 2022 with respect to a previous application.

The ruling

The tenancy is terminated effective May 12, 2023. The Tenant must pay the Landlord $4,447.53, which includes rent arrears up to May 1, 2023 and the cost of the previous application, less the rent deposit and interest on the deposit. The Tenant must also pay the Landlord $68.83 per day for compensation for use of the unit starting May 2, 2023 until the Tenant moves out.
