What happened
Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant committing an illegal act by assaulting another tenant, and the Tenant seriously impairing the safety of the victim.
The ruling
The tenancy is terminated effective July 23, 2023. The Tenant must move out of the rental unit by that date. If the unit is not vacated by July 23, 2023, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement starting July 24, 2023. The Tenant shall pay the Landlord $186 for the cost of filing the application. The Landlord owes the Tenant $1,210.94 for the rent deposit and interest, which exceeds the amount the Landlord is entitled to. However, the Landlord is authorized to deduct $39.79 per day for compensation for the use of the unit starting April 14, 2023 until the Tenant moves out.
