What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to Tenant's failure to meet a condition specified in the mediated settlement signed by the parties on January 25, 2022 with respect to a previous application.

The ruling

The tenancy is terminated effective May 7, 2023. The Tenant must pay the Landlord $13,828.75, which includes the remaining rent arrears from the previous mediated settlement and new arrears, minus the rent deposit and interest on the deposit. The Tenant must also pay the Landlord $63.43 per day for compensation for use of the unit starting April 27, 2023 until the Tenant moves out.
