What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant attended the hearing and requested an adjournment to raise issues under section 82 of the RTA, but the request was denied as it was deemed procedurally unfair to the Landlord due to the lack of prior disclosure and the substantial amount of rent owed.

The ruling

The tenancy is terminated unless the Tenant pays the Landlord $35,970.00 by June 14, 2025. If the payment is not made, the Tenant must move out by June 14, 2025, and pay the Landlord $26,260.84 (representing arrears up to the hearing date, plus the application fee, less the deposit and interest). The Tenant must also pay daily compensation of $85.15 from April 9, 2025, until they vacate.
