What happened
The Tenant applied for an order determining that the Landlord collected or retained money illegally. Specifically, the Tenant alleged that the Landlord failed to apply the last month's rent deposit to the final month of the tenancy and instead withdrew a full month's rent from the Tenant's bank account on October 1, 2024. The Tenant also sought unpaid interest on the rent deposit.
The ruling
The Landlord is ordered to pay the Tenant $1,516.78 by September 14, 2025. This amount includes the return of the last month's rent deposit ($1,390.00), interest on that deposit ($78.78), and the application filing fee ($48.00). If payment is not made by the deadline, interest will accrue at 4% annually.
