What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant experienced medical hardship after breaking an ankle in January 2025, leading to significant rent arrears. While the Tenant proposed a repayment plan, the Board found it unfair to the Landlord as the Tenant could not guarantee future full rent payments on time.

The ruling

The tenancy is terminated effective July 31, 2025, unless the Tenant pays $4,261.00 to void the order. If the Tenant does not void the order, they must vacate by the termination date and pay the Landlord $2,459.63, which accounts for arrears and filing fees minus the rent deposit and interest. Daily compensation of $26.79 is required for each day the Tenant stays past June 25, 2025.
