What happened

The Tenant requested a review of an order terminating the tenancy for non-payment of rent. The Tenant claimed he was not informed of the hearing date and believed a subsequent court date would be scheduled to address maintenance issues regarding a lack of heat. Upon review of the audio recording, the Board found that the Tenant did attend the original hearing and was correctly informed that maintenance issues could not be raised under section 82 without prior disclosure, but could be pursued through a separate application.

The ruling

The request to review the order issued on September 19, 2025, is denied. The Board found that the Tenant participated in the original hearing and was not denied procedural fairness. The original order remains confirmed and unchanged.
