What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants because they failed to pay the lawful rent. A valid N4 Notice was served, but the Tenants did not void it by paying the arrears. The Tenants did not attend the hearing, and no payments were made following the application filing, resulting in a significant increase in arrears.

The ruling

The tenancy is terminated effective October 4, 2025, unless the Tenants pay $8,586.00 by September 30, 2025, or $9,986.00 by October 4, 2025, to void the order. If the Tenants do not void the order and fail to move out, the Landlord can enforce the eviction through the Sheriff starting October 5, 2025. The Tenants are also ordered to pay $6,105.90 for arrears and the filing fee (after deposit deductions) plus daily compensation of $46.03 until they vacate.
