What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant did not void the N4 notice by paying the arrears.

The ruling

The tenancy will be terminated on June 17, 2023 unless the Tenant pays $2,107.31 by May 31, 2023 or $4,056.38 by June 17, 2023 to void the order. If the unit is not vacated by June 17, 2023, the Landlord may file the order with the Sheriff for enforcement. The Landlord owes the Tenant $1,088.75 for the rent deposit and interest, but can deduct $64.08 per day for the Tenant's continued occupation starting May 12, 2023.
