What happened
The Landlord applied for an order to terminate the tenancy and evict unauthorized occupants because the Tenant transferred occupancy of the unit to his adult children without the Landlord's consent after the Tenant moved into a long-term care facility. The occupants were offered the chance to apply for a new tenancy at market rent but did not do so and remained in the unit without authorization.
The ruling
The tenancy is terminated. The Unauthorized Occupants are ordered to vacate the unit by September 14, 2025. They must pay the Landlord daily compensation of $38.74 from June 1, 2025, until they move out, plus the $201.00 filing fee. The Landlord must apply the Tenant's rent deposit and interest ($1,211.07) to offset these amounts or return it to the Tenant.
