What happened

The Landlords applied for termination of tenancy and eviction due to non-payment of rent. The Tenant did not dispute the arrears but sought a payment plan. However, the Tenant's monthly income as an artist equals the monthly rent, making a repayment plan unfeasible in the eyes of the Board. The Tenant expressed concerns that the Landlords were attempting to evict all occupants of the building without justification.

The ruling

The tenancy is terminated effective September 30, 2025. The Tenant is ordered to pay $8,116.62 for rent arrears up to the hearing date and the application fee. To void the eviction, the Tenant must pay $8,861.00 (which includes rent up to September 30) by September 30, 2025. The adjudicator granted a short delay in eviction until the end of September to allow the Tenant time to find alternate housing.
