What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. One of the tenants, Lorence Charter, had fled the country in December 2022 and did not attend the hearing.
The ruling
The tenancy is terminated effective December 4, 2023 unless the tenants pay $26,755.66 to void the order. If the tenants do not pay, they must vacate the unit by December 4, 2023 and pay the landlord $24,484.83 plus daily compensation of $60.69 from November 8, 2023 until the date they move out.
