What happened
The Landlords applied to evict the Tenant and a Former Tenant for non-payment of rent. At the hearing, the primary dispute was whether the Former Tenant, who had moved out, was still liable for the rent arrears. The Board determined the Former Tenant had been released from the tenancy agreement as of December 31, 2024, based on the actions and communications of all parties. The remaining Tenant was found solely responsible for the arrears. The parties agreed to a termination date and a payment plan for the outstanding amount.
The ruling
The Board ordered the tenancy terminated on June 10, 2025, per the parties' agreement. It was determined that the Former Tenant was released from the tenancy effective December 31, 2024, and is not liable for rent arrears. The remaining Tenant is solely responsible for paying the Landlords $8,177.34, which includes rent arrears and the application fee, less the rent deposit and interest. The payment is to be made in monthly installments of $600.00.
