What happened
The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to pay rent as ordered in a previous LTB order. The landlord was entitled to apply for this order without notice to the tenant as the previous order specified the conditions under which the landlord could do so.
The ruling
The tenancy is terminated effective May 5, 2023. The tenant must pay the landlord $6,171.60 plus $103.56 per day from April 25, 2023 until the tenant vacates the unit. If the tenant does not pay the full amount by May 5, 2023, the tenant will owe interest at 6% annually on the outstanding balance.
