What happened

Tenants applied for an order determining that the Landlord collected or retained money illegally by increasing the rent beyond the allowable guideline. The Landlord purchased the property in 2019 and renovated it, dividing it into two units. The Tenants moved into the upper unit in 2020. The Landlord claimed the unit was exempt from rent control, but the Tenants argued it was not a new unit and the rent increases were unlawful.

The ruling

The Landlord collected rent in excess of the amount allowed by the Residential Tenancies Act, 2006. The Landlord shall pay the Tenants $1,713, which includes the excess rent collected and the cost of filing the application.
