What happened

The landlord applied for an order to terminate the tenancy and evict the tenant due to non-payment of rent. The landlord served a valid N4 notice, but the termination date was defective as it was not at least 14 days after the date the notice was served. The tenant requested an adjournment to raise issues under section 82 of the Act, but the board did not permit this as the tenant did not provide the required advance notice.

The ruling

The tenant shall pay the landlord $12,786 for rent arrears up to March 31, 2023 and application costs. If the tenant does not pay the full amount by April 30, 2023, they will start owing interest at 6% annually on the outstanding balance.
