What happened
The Tenants applied for an order determining that the Landlord harassed, obstructed, coerced, or threatened them to move out. The Tenants alleged that the Landlord's agent pressured them to sign an N11 agreement to terminate the tenancy because the Landlord wanted to sell the property. The Landlord's agent denied these allegations, stating he only inquired about their plans after they previously indicated they were looking for a larger house. This hearing was a de novo review following a successful review request by the Landlord.
The ruling
The Tenants' application (T2) alleging harassment and coercion by the Landlord's agent was dismissed. The Member found that the Tenants did not prove their allegations on a balance of probabilities, as the testimony from both sides was conflicting and neither side provided sufficient evidence to outweigh the other.
