What happened
The Landlord applied to evict the Tenant due to serious fire safety hazards caused by hoarding in the rental unit. The Tenant appealed the Landlord and Tenant Board's eviction order to the Divisional Court. The Landlord brought a motion to quash the Tenant's appeal.
The ruling
The court granted the Landlord's motion to quash the Tenant's appeal and lift the stay of eviction. The court found that none of the Tenant's grounds of appeal raised questions of law and were therefore manifestly devoid of merit. The Tenant was ordered to pay $4,000 in costs to the Landlord.
