What happened
The Landlord requested a review of a previous order that dismissed an application for rent arrears. The previous dismissal was based on a perceived failure to meet service timelines. On review, the Adjudicator found that the Landlord was denied procedural fairness because they were not given an opportunity to address the Board's concerns regarding service during the original hearing. A rehearing was conducted, establishing that the Tenant owed arrears from a period between 2022 and 2023.
The ruling
The review request was granted, and the previous dismissal was cancelled. The Board ordered the Former Tenant to pay the Landlord $4,022.97 by December 15, 2025. This amount includes rent arrears and the application filing fee, adjusted for the rent deposit and interest held by the Landlord. If the Tenant fails to pay, interest will accrue at a rate of 4.00% annually.
