What happened
The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to pay rent as required by a previous LTB order. The landlord was entitled to apply for this order without notice to the tenant since the tenant did not meet the condition specified in the previous order.
The ruling
The tenancy is terminated effective May 28, 2023. The tenant must pay the landlord $17,948.32 (less any payments made after the application was filed) for rent arrears and the cost of the previous application. The tenant must also pay the landlord $62.79 per day for compensation for the use of the unit starting May 18, 2023 until the tenant moves out.
