What happened
The Landlord applied for eviction and rent arrears following non-payment by the Tenant. The Tenant raised multiple Section 82 maintenance issues, including non-functional appliances, landscaping concerns, and unauthorized entries. The Tenant vacated the property before the final hearing, and the LTB evaluated the maintenance claims to determine if any rent abatement was necessary.
The ruling
The tenancy was terminated effective the date the Tenant moved out. All of the Tenant's counterclaims for maintenance and interference were dismissed. The Tenant is ordered to pay $6,442.60 to the Landlord, covering rent arrears, NSF fees, and the application filing fee.
