What happened

Landlord applied to terminate the tenancy and evict the Tenant due to the Tenant seriously impairing the safety of others by allowing a mattress to smoulder as a result of smoking in the unit, and for willfully causing undue damage to the premises. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.

The ruling

The tenancy is terminated as of September 15, 2024 due to the Tenant seriously impairing the safety of others by allowing a mattress to smoulder due to smoking, and the Tenant's continued smoking in the unit despite the prohibition. The Tenant is ordered to pay the Landlord $186 for the application filing fee by August 18, 2024, and if not paid, will owe interest. If the Tenant does not vacate by September 15, 2024, the Tenant will owe $24.99 per day until the unit is vacated, and the Landlord may file the order with the Sheriff for enforcement.
