What happened
The landlord, Cityhousing Hamilton Corporation, applied for an order to terminate the tenancy and evict the tenant, David Ryan, due to non-payment of rent. The landlord served a valid N4 Notice, and the tenant did not void the notice by paying the rent arrears.
The ruling
The tenant is ordered to pay $507 to the landlord, which includes rent arrears up to June 30, 2023 and the landlord's application filing costs. The tenant is also ordered to pay new rent on time and in full until the arrears are paid or May 31, 2024, whichever is earlier. If the tenant fails to make any of the ordered payments, the landlord may apply to the LTB for an order terminating the tenancy and evicting the tenant.
