What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to significant rent arrears. The Tenant failed to attend the hearing. During the proceedings, the LTB discovered that the Landlord attempted to implement a rent increase that exceeded the 2025 guideline by rounding up the calculation by a fraction of a cent, rendering the increase unlawful. Consequently, the lawful rent was reset to the previous rate.
The ruling
The tenancy is terminated effective November 15, 2025, unless the Tenant voids the order by paying $7,784.50. If the Tenant does not pay and fails to move out, the Landlord can enforce eviction through the Sheriff. The Tenant is ordered to pay a total of $6,504.50 for arrears and costs, after applying the rent deposit and interest, plus daily compensation of $17.84 from October 22, 2025.
