What happened

The Tenant filed a motion to set aside an ex-parte eviction order (LTB-L-050058-24) which was issued because the Tenant breached a condition from a previous consent order (LTB-L-003380-24) by failing to pay the rent due on June 1, 2024. The Tenant sought to have the eviction order set aside, but the motion was denied.

The ruling

The Tenant's motion to set aside a previous eviction order was denied. The Board found it would be unfair to set the order aside because the Tenant was aware of his financial issues when he agreed to the initial payment plan, failed to prioritize rent even after his income was restored, and the rent arrears had significantly increased. The stay on the eviction order was lifted, with the eviction to be enforced on or after May 30, 2025.
