What happened

The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to meet a condition specified in a previous mediated settlement order. The landlord alleged the tenant was smoking inside the rental unit, which was a breach of the previous order.

The ruling

The tenancy is terminated, and the tenant must move out by May 20, 2023. If the unit is not vacated by that date, the landlord may file the order with the Court Enforcement Office for enforcement. The tenant must pay the landlord $10.09 per day for use of the unit from May 10, 2023 until the tenant moves out, and interest will accrue on any unpaid amount starting May 21, 2023.
