What happened
The Landlord applied for an order to terminate the tenancy based on the Tenant's failure to meet conditions from a previous LTB order. An ex-parte order was issued on December 13, 2024. The Tenant filed a motion to set aside that order. During the hearing on the motion, the parties reached a consent agreement to restore the Tenant's possession of the unit and allow the Tenant to void the eviction by paying outstanding rent arrears by a specific deadline.
The ruling
The LTB granted the Tenant's motion to set aside a previous eviction order. By consent, the Landlord was ordered to restore possession of the unit to the Tenant immediately. The Tenant is required to pay $1,028.34 to the Landlord by May 7, 2025, to void the termination of the tenancy. If payment is not made, the Landlord may enforce the eviction starting May 14, 2025.
