What happened
Tenant applied for an order determining the Landlord failed to meet maintenance obligations, specifically regarding heating. Tenant alleged the Landlord did not provide heat starting in September 2022, necessitating the purchase of a space heater. Landlord contended that the heating system is automated based on indoor temperature sensors and that the Tenant actually installed a decorative fireplace, not a space heater.
The ruling
The Tenant's application is dismissed. The Board found that the Tenant failed to provide sufficient evidence that the Landlord breached maintenance obligations or that the indoor temperature fell below the legal requirements. Claims for reimbursement of heating equipment and hydro costs were rejected.
