What happened
The Landlord applied to evict the Tenant for non-payment of rent. The arrears accumulated after the Tenant's rent was increased from a rent-geared-to-income rate to the market rate because the Tenant, due to mental health issues, failed to submit her annual income report. The Tenant, a long-term resident of 9 years with four children, was granted a postponement of the eviction to allow her time to rectify the situation with the help of Tenant Duty Counsel.
The ruling
The tenancy is conditionally terminated. The Tenant can void the eviction order by paying $7,812.00 by June 30, 2025, or a total of $8,626.00 by July 31, 2025. This postponement was granted to allow the Tenant, with the help of Tenant Duty Counsel, to resolve financial issues stemming from a loss of her rent subsidy due to mental health challenges. If the order is not voided, the Tenant must vacate by July 31, 2025, and pay the Landlord $7,234.92 plus daily compensation for any overholding.
