What happened
The Tenants filed a T2 application alleging harassment by the Landlords. The alleged harassment included repeated requests to set up a separate propane account despite utilities being included in the rent, issuing a notice to enter for an inspection that didn't happen, and serving/attempting to serve N12 notices for personal use which were not pursued. The Tenants' request to amend their application to include substantial interference and a rent abatement was denied due to improper and late service. The Board dismissed the Tenants' application, finding the alleged incidents did not meet the burden of proof for harassment under the RTA.
The ruling
The Tenants' application alleging harassment by the Landlord was dismissed. The Board denied the Tenants' last-minute request to amend their application. All claims for financial compensation, an administrative fine, and an order for the Landlord to cease the alleged behaviour were dismissed. The Board found the Tenants failed to provide sufficient evidence that the Landlord's actions (discussing utilities, giving notice for entry, and serving N12 notices) constituted harassment under the RTA, and granted the Landlord's motion for a non-suit.
