What happened
The Tenant applied for the return of her last month's rent (LMR) deposit. Although the Tenant provided notice to terminate the tenancy effective December 31, 2024, and the Landlord had agreed to the early termination, the Landlord changed the locks and re-rented the unit to a new occupant on December 1, 2024. The Landlord also allegedly harassed the Tenant with numerous late-night phone calls following her request for the deposit refund.
The ruling
The Landlord is ordered to pay the Tenant $1,043.00 by October 13, 2025. This amount includes the return of the $995.00 last month's rent deposit, which the Landlord illegally retained after re-renting the unit and changing the locks before the agreed tenancy end date, plus the $48.00 application fee.
