What happened

The Landlord applied for the termination of the tenancy and eviction because the Tenant allegedly smoked in the rental unit or on the balcony, which is prohibited by the lease and interferes with the reasonable enjoyment of other tenants and the Landlord. The Landlord served two N5 notices. The Tenant did not attend the hearing.

The ruling

The LTB issued a conditional order. The tenancy will continue as long as the Tenant does not smoke in his rental unit, on the balcony, or in any part of the residential complex from November 4, 2025, to November 3, 2026. If the Tenant breaches this condition, the Landlord may apply for an eviction order without further notice. The Tenant must also pay the Landlord $186.00 for the application filing fee.
