What happened

The Landlord applied to terminate the tenancy and evict the Tenant, alleging that the Tenant seriously impaired the safety of the residential complex by disconnecting the smoke alarm in the rental unit on multiple occasions. The Tenant admitted to disconnecting the alarm but explained it was due to persistent false alarms and requested a conditional order to maintain the tenancy.

The ruling

The LTB refused to evict the Tenant but issued a conditional order. The tenancy continues provided that the Tenant does not disconnect or render the smoke alarm non-functional until August 29, 2026. If the Tenant breaches this condition, the Landlord may apply for an ex parte eviction order. The Tenant is also ordered to pay the Landlord $186.00 for the application filing fee.
