What happened
The Tenant requested a review of an order terminating the tenancy for non-payment of rent. The Tenant missed the original hearing, claiming he forgot due to a demanding job and personal issues. He also alleged a serious error because the original order underestimated the amount he actually owed. The Landlord sought to lift the stay of the eviction order, noting no rent had been paid since February 2025.
The ruling
The LTB denied the Tenant's request for a review of the eviction order. The Member found that the Tenant missed the original hearing due to his own lack of diligence and that his claim of a 'serious error' (owing more than ordered) did not justify a rehearing. The stay of the eviction was lifted immediately, as the Tenant had not paid rent for six months and his plan to pay via an estate settlement was deemed speculative.
