What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenant did not void the notices by paying the arrears.

The ruling

The tenancy is terminated effective January 21, 2024. The Tenant is ordered to pay the Landlord $13,024.57, which includes rent arrears, application filing fees, and NSF charges, minus the rent deposit and interest owed to the Tenant. The Tenant must also pay the Landlord $65.75 per day for use of the unit from December 20, 2023 until the Tenant vacates. If the Tenant does not pay the full amount by January 21, 2024, the Landlord may file the order with the Court Enforcement Office for eviction.
